Thomas Spota, Suffolk County District Attorney, has been accused by federal prosecutors of obstructing justice.

Suffolk County, New York, District Attorney Thomas Spota has been charged with obstructing an investigation into the beating of a suspect by the county's then-police chief.

Spota was set to face a judge in federal court on Wednesday.

A lawyer for a district attorney in NY charged with obstructing a federal civil rights investigation into the beating of a handcuffed prisoner by a police chief says his client denies the charges. Federal prosecutors accused both officials of using threats and intimidation to pressure witnesses to provide false information to federal agents during their investigation of James Burke, the former county police chief who pleaded guilty to brutally beating a man who burglarized the chief's auto in 2012. "The crimes they're charged with are rivaled only by the conduct they allegedly attempted to hide".

Suffolk County Executive Steve Bellone and Police Commissioner Timothy Sini, both Democrats, have called for the prosecutor to resign.

Spota, 76, is not seeking re-election after 16 years in office.

Burke pled guilty previous year to accusations that he'd tortured a prisoner in his custody.

The U.S. Attorney's Office and the FBI initiated a federal grand jury investigation of the assault in April 2013, which led to the indictment unsealed Wednesday. The suspect, who was later convicted by a special prosecutor, was accused of stealing a duffel bag in Burke's vehicle that contained cigars, sex toys and pornographic DVDs.

Spota, who was first elected in 2002, is under indictment in a salacious police-brutality cover-up.

Spota and McPartland were accused of using their positions to pressure witnesses to keep them from cooperating in the beating investigation.
