Quinn told reporters on Monday that he will prepare for the Cowboys to have their No. 1 running back come Sunday.

Elliott could still start serving the suspension as early as this week if the ruling is not in his favor.

It's unclear how many games they have proposed to the NFL, but neither the league nor the NFLPA intends to settle this case and have Elliott's suspension reduced at this time, sources said.

The NFL, however, found there was sufficient evidence to suspend Elliott six games - the baseline punishment for domestic violence under the league's personal conduct policy - in August.

An appeals court granted Elliott a stay as well as a motion from NFL Player Association lawyers for an expedited appeal Friday morning.

He played five games before that decision was thrown out by Fifth Circuit U.S. Court of Appeals because of improper jurisdiction by the Texas Court.

Last Friday, Judge Susan Carney of the Second Circuit issued an administrative stay of Elliott's suspension, which unexpectedly allowed him to return to the Cowboys and play on Sunday against the Kansas City Chiefs. The trio of backs took the work last week in practice before Elliott rejoined the team. A federal judge there granted the union's request for a temporary restraining order for Elliott.

It is possible, if not likely, that the three-judge panel in NY will rule as early as Thursday, after oral arguments, on whether Elliott can play Sunday at Atlanta.
