The Democratic House of Delegates candidate who is now tied with the Republican incumbent for the 94th District in Newport News is challenging the election recount that resulted in a tie.

Election officials say they've postponed their plan to break a tie in a Virginia House race that could decide party control of the chamber. This was substantial because with her win the Virginia House of Delegates would be at a 50/50 political party split.

The race in the Newport News-area 94th District is now tied between Republican Del.

Democrat Shelly Simonds reacts to the news that she won the 94th District precincts by one vote after previously trailing incumbent David Yancey by ten votes post-election, following a recount on December 19.

"My opponent made an end run around the clear rules of the recount", Simonds said during a conference call with reporters. The person voted for Republicans in other state elections. A day later, a court in Newport News declared a tie. David Yancey were scheduled to put their names into a bowl.

The Simonds campaign filed its motion electronically. For the 94th District, the voter filled in the bubble for Yancey and the bubble for Simonds.

Simonds's campaign has also requested the drawing be delayed so it can convince the court that the vote shouldn't be counted.

After about two hours, the panel of judges awarded the vote to Yancey, tying the race at 11,608 to 11,608.

Gretchen Heal, a spokeswoman for the Yancey campaign, declined to comment Tuesday on the Simonds campaign's planned litigation.

Democrat Joshua Cole lost to Republican Bob Thomas by 82 votes in November and by 73 votes in a recount last week.
