Argument analysis: OH voter-registration practices safe?

The laws prohibit states from removing people from voter rolls "by reason of the person's failure to vote". That law says a voter can't be removed simply because of a failure to vote. But is that a reasonable conclusion to draw, she asked, when it has a disproportionate effect on areas with large groups of minorities, poor people and the homeless?

Ahead of Wednesday oral arguments for a Supreme Court case that could boost efforts to aggressively purge voter rolls, voting rights advocates weren't optimistic that they'd get a sweeping ruling in their favor, given the court's conservative make-up. Seventeen states, generally Republican, filed a brief on the other side.

Signaling support for Ohio's defense of the process, Justice Anthony Kennedy said states are "trying to protect their voter rolls ..."

All of the U.S. Supreme Court justices - or at least the seven that spoke on Wednesday - seemed to agree that voting can not be a "use it or lose it" right.

Justice Samuel Alito was the most vocal of the court's conservative justices, asking several questions about the "sole proximate cause" claim by OH that seemed created to press his colleagues on the court into agreeing that the notification process did not violate the NVRA.

Prof. Rick Hasen, an election law expert at the University of California at Irvine, says if the court sides with OH, "you'll see more red states making it easier to drop people from the voter registration rolls, and it's going to continue what I call the voting wars between the parties". Seven states use a process similar to Ohio's, so potentially millions of voters around the country will be affected by the court's decision.

But civil rights groups, ethnic groups, and people with disabilities have joined forces, saying that OH, which has the strictest voter roll laws in the nation, is violating their constitutional right to vote.

It's an issue embedded in the controversy before the Supreme Court today involving Ohio's practice of purging the voter-registration rolls of anyone who doesn't vote in two consecutive elections and then doesn't answer a piece of mail asking for an address confirmation (or doesn't subsequently vote in two additional elections). The states share information about modernizing their systems as well as seeking to identify people who have moved across state lines or died.

The state says it removes names only after local election boards send notices and theres no subsequent voting activity for the next four years. If the voter does not return the notice and does not vote for the next four years, he is removed from the voter lists. He said many of those dropped from the rolls first learn they're not registered when they show up to vote and are turned away.

Late a year ago, President Donald Trump's administration reversed the government's position on a voter roll case before the U.S. Supreme Court and is now backing Ohio's method for purging voters. "It's quite unusual your office would change its position so dramatically".

Ho says says that Georgia, Montana, Oregon, West Virginia, Pennsylvania and Oklahoma also have a culling process that's triggered by inactivity, but Ohio's two-year trigger is the shortest of any state.

The plaintiffs, represented by liberal advocacy group Demos and the American Civil Liberties Union, said purging has become a powerful tool for voter suppression.

Ohio's policy would have barred more than 7,500 voters from casting a ballot in the November 2016 election had the Cincinnati-based 6th U.S. Circuit Court of Appeals not ruled against the state.

Loyola professor Levitt meanwhile emphasized that the case is one of statutory interpretation, meaning the balance of harm to the state and to voters will take a backseat to finer points of the NVRA itself. He said he never saw the notice. The process has been in place for more than 20 years and has been administered the same way by both Republican and Democratic secretaries of state, says Husted.

"We believe our state is one where we make it easy to vote and hard to cheat".

Supreme Court justices battled Wednesday over how to interpret the confusion surrounding a 1993 motor-voter law and what steps states need to take before ousting someone from their voter lists, as a national debate rages over how far states can go to clean up their rolls. Clearly, this provision will be debated at the Supreme Court when this OH case is heard this week. The system in OH is the most aggressive in the country.
