After trying unsuccessfully for months to obtain lethal injection drugs, Oklahoma officials said Wednesday they plan to use nitrogen gas to execute inmates once the state resumes using the death penalty, marking the first time a USA state would use the gas to carry out capital punishment.

Death penalty opponents are already expressing skepticism about the use of nitrogen and demanding that Oklahoma be transparent as it preps a new protocol.

In a statement, Dale Baich, an assistant federal public defender, who is representing Oklahoma death row prisoners in an execution method lawsuit, said the process must proceed with "due diligence and caution".

After the state executed Charles Warner in January 2015, officials acknowledged they had used the wrong drug for his lethal injection, and hastily called off another execution.

The state intends to adopt the new execution method as prison officials are unable to acquire the necessary drugs for lethal injections - the method now employed by all American states that carry out the death penalty. Unknowns remain, give that state officials only recently began developing the protocols. In 2015, Oklahoma legislators passed and Gov. Mary Fallin signed into law a bill that allows nitrogen hypoxia as an execution method. That's caused forced delays and changes in protocol in several states.

In assisted suicides, nitrogen hypoxia ends life by reducing the oxygen that is breathed in, sometimes with a hood or other device placed over the head.

DOC Director Joe Allbaugh said Wednesday that many death row inmates have been employing various methods, including dehydrating themselves, leading up to their executions that ensure challenges for the medical staff attempting lethal injection.
